• Housing that meets federal housing regulations and passes inspection



• Transportation for workers from Laredo, Texas to your farm and return transportation at the end of the contract



• Pay workers the agreed upon contract rate for at least 75% of the hours specified in the contract



• Report any breach of contract to US Department of Labor and Homeland Security immediately

Breakdown of the Recruitment Process

The H2-A recruiting process takes approximately 15 weeks, from application to arrival, and includes the following steps:

• Initiate contact with the US Department of Labor via Form 790
• Advertise the job opening according to H2-A regulations
• Contact any former employees you wish to include in your labor order
• Notify US Department of Labor the results of job advertising
• Petition Homeland Security for the number of work visas needed
• Wait for Homeland Security to notify the Consulate of work visa approval
• Qualified farm workers with passports are interviewed at the Consulate
• Workers are transported from Laredo, Texas to your location

How to prepare for your H2-A Labor Application

• Plan your season timeline and headcount to determine how many H2-A workers you need to apply for and what date you would like them to start. Crews start dates can be staggered to accommodate peak workload and slower parts of your season.



• List skills needed based on tasks to be performed. Contracts with H2-A laborers are based on the tasks you expect them to perform and the skills needed to perform those jobs to your standards.



• Prepare for and pass housing inspection. You must provide housing for H2-A workers that meets Department of Labor standards and has passed inspection before your workforce arrives.



• Contact former employees you would like to rehire. Workers with passports can be specifically requested as part of your H2-A crew.
